Alisa A. Lipski

Ms. Lipski is a Member of the Houston, Texas based intellectual property law firm of Goldstein & Lipski PLLC and is one of seven patent litigation attorneys with the firm. Ms. Lipski is licensed to practice in both Texas and California, as well as in front of the United States Patent and Trademark Office.

Ms. Lipski's focus is on intellectual property protection, primarily patent infringement litigation and appeals. Her interest in intellectual property also extends to patent prosecution, particularly reexaminations and reissues in preparation for and during patent infringement litigation. Ms. Lipski has has represented a number of clients in popular patent districts such as the Eastern District of Texas and the Northern District of California.

In addition to providing client counseling, patent license negotiation and written argument, Ms. Lipski has argued a number of Markman and summary judgment hearings in various District Courts and has argued in front of the Federal Circuit. Ms. Lipski has also handled a patent reexamination in which all of the original claims were allowed without changes.

Experience

  • While attending law school, Ms. Lipski was a judicial intern for Magistrate Judge Nancy Johnson in the United States District Court for the Southern District of Texas (November 2002 - April 2003)
  • Since starting with the firm in 2004, Ms. Lipski has participated in numerous patent litigation lawsuits seeking the recovery of patent infringement damages in federal Courts around the country. Major patent litigation lawsuits include contingency fee patent litigation against industry leaders in a variety of fields, including telecommunications and biotechnology.

Representative Engagements
Advanced Biological Laboratories (www.ablsa.com) is a biotech company founded in 2000 as a spin-off from the European academic research centre, CRP-Santé, Luxembourg . ABL's expertise lies within infectious diseases, with particular focus on resistance patterns and clinical outcome predictors for HIV-1, tuberculosis, hepatitis, malaria and human papillomavirus (HPV) infections. For ABL, Ms. Lipski, along with Mr. Goldstein, obtained a patent immunity agreement with Stanford University , as well as a non-exclusive, royalty-bearing license agreement with Viralliance, Inc., a corporation which develops technologies to evaluate in vitro drug potency on patient's derived viruses. GL has also resolved several U.S. business disputes for ABL. Goldstein & Lipski continues to represent ABL in assertion of its U.S. patents against major commercial entities.

Genetic Applications (www.geneticapplications.com) supplies the commercial biotechnology industry with a variety of tools, including reagents for gene expression, analysis and quantification. Along with counsel based in the Eastern District of Texas, Ms. Lipski represented Genetic Applications in its assertion of a patent against a major competitor. Defendant filed a Motion to Stay the case pending re-examination of the patent, which Goldstein & Lipski opposed. The Court agreed with Goldstein & Lipski. In an effort to further delay the case, a Motion to Transfer and/or Dismiss was filed by the defendant in an attempt to transfer the case to its home state, or dismiss it entirely. Goldstein & Lipski also won its opposition to that motion, keeping the suit in the Eastern District of Texas. Goldstein & Lipski's continuing success against the delay tactics used by the defendant put its client in a strong position. Terms of the settlement are confidential.
